Hướng dẫn thủ tục Chứng nhận Apostille và Hợp pháp hoá lãnh sự

Guidelines on Apostille Certification and Consular Legalization for Diplomas, Academic Records, and Official Documents

129 Việt Nam đã nộp văn kiện gia nhập Công ước Apostille ngày 31/12/2025 và chính thức trở thành thành viên thứ 129, có hiệu lực từ 11/09/2026. Giấy tờ do Việt Nam cấp chỉ cần Apostille khi dùng tại 128 quốc gia thành viên còn lại, không cần hợp pháp hóa lãnh sự. Vietnam submitted its instrument of accession on Dec 31, 2025 and became the 129th member, effective Sep 11, 2026 — Vietnamese-issued documents now only need an Apostille (not legalization) to be used in the other 128 member states.

Căn cứ các quy định hiện hành về việc cấp chứng nhận Apostille và Hợp pháp hoá lãnh sự (Nghị định số 293/2026/NĐ-CP có hiệu lực từ ngày 11/09/2026), Công ty cổ phần DELULU xin thông báo hướng dẫn cụ thể về thủ tục công nhận giấy tờ, văn bằng sử dụng trong nước và quốc tế như sau:

Pursuant to current regulations on Apostille certification and consular legalization (Decree No. 293/2026/ND-CP effective from September 11, 2026), DELULU JSC hereby announces the detailed guidelines for the authentication of diplomas, academic credentials, and official documents as follows:

Đối tượng đề nghị cấp chứng nhận Apostille

Eligibility to Request Apostille Certification

Cơ quan, tổ chức, cá nhân có thể đề nghị cấp chứng nhận Apostille đối với giấy tờ, tài liệu của mình hoặc của người khác mà không cần giấy ủy quyền. Người đề nghị cấp chứng nhận Apostille cho giấy tờ, tài liệu của người khác phải chịu trách nhiệm trước pháp luật về tính hợp pháp của việc nộp, sử dụng giấy tờ và tuân thủ quy định pháp luật về bảo vệ dữ liệu cá nhân.

Agencies, organizations, and individuals may apply for an Apostille certification for their own documents or on behalf of others without requiring a power of attorney. Anyone submitting documents on behalf of others bears full legal responsibility for the legitimacy of the submission, use of documents, and strict compliance with personal data protection laws.

Phạm vi giấy tờ công được cấp chứng nhận Apostille

Scope of Public Documents Eligible for Apostille

1Giấy tờ tố tụng, thi hành án

Bản án, quyết định, văn bản tố tụng của Tòa án, Viện kiểm sát, Cơ quan điều tra; quyết định, biên bản thi hành án dân sự, hình sự; vi bằng và văn bản do Thừa phát lại, Thừa hành viên lập.

Judgments, rulings, procedural documents of Courts, Procuracies, Investigation Agencies; civil/criminal enforcement decisions; bailiff's certified records and deeds.

2Giấy tờ hành chính

Giấy tờ về hộ tịch, quốc tịch, nuôi con nuôi; phiếu lý lịch tư pháp; văn bằng, chứng chỉ, giấy xác nhận kết quả học tập/nghiên cứu; giấy khám sức khỏe, giấy chứng nhận y tế; các văn bản hành chính công khác do cơ quan nhà nước cấp.

Civil status, nationality, adoption papers; judicial record cards/police checks; degrees, diplomas, certificates, transcripts/research certifications; medical check-up reports, health certificates; and other public administrative documents.

3Văn bản công chứng

Hợp đồng, giao dịch, bản dịch và bản sao đã được công chứng.

Notarized contracts, agreements, certified translations, and certified true copies.

4Văn bản chứng thực

Chứng thực bản sao từ bản chính; chứng thực chữ ký (bao gồm chữ ký của người dịch); chứng thực hợp đồng, giao dịch.

Certifications of true copies from originals; certification of signatures including translator signatures; and certified transactions.

5Các giấy tờ công khác

Các giấy tờ công do cơ quan, tổ chức có thẩm quyền của Việt Nam lập, cấp hoặc chứng nhận khi thực hiện chức năng, nhiệm vụ (trừ các trường hợp quy định tại mục IV).

Other public documents issued or certified by competent Vietnamese authorities within their official mandates, except those specified in Section IV.

Cơ quan & phương thức nộp hồ sơ tại Việt Nam

Competent Authorities & Submission Methods in Vietnam

Cơ quan có thẩm quyền

Bộ Ngoại giao là cơ quan có thẩm quyền cấp chứng nhận Apostille của Việt Nam; cụ thể thực hiện qua Cục Lãnh sự và Sở Ngoại vụ TP. Hồ Chí Minh (hoặc các UBND cấp tỉnh được phân cấp thẩm quyền theo lộ trình quy định).

The Ministry of Foreign Affairs is the competent authority for issuing Apostilles in Vietnam, carried out via the Consular Department and the Department of Foreign Affairs of Ho Chi Minh City, as well as designated provincial People's Committees.

Phương thức nộp hồ sơ

Trực tiếp / Bưu chính: nộp tại Bộ phận Một cửa hoặc gửi qua dịch vụ bưu chính.
In-person at the Single-Window Office or via postal services.
Trực tuyến: nộp toàn trình trên Cổng Dịch vụ công quốc gia hoặc VNeID.
Fully online via the National Public Service Portal or the VNeID app.

Quy trình sử dụng giấy tờ nước ngoài tại Việt Nam

Procedure for Using Foreign Documents in Vietnam

Áp dụng cho giảng viên, chuyên gia quốc tế hoặc nhân sự tốt nghiệp ở nước ngoài. · For international faculty, experts, or staff with overseas qualifications.

Đem giấy tờ gốc đến đúng Cơ quan có thẩm quyền của nước đó (hoặc Cơ quan đại diện ngoại giao nước sở tại tại Việt Nam) để xin dán tem Apostille.

Take the original documents to the competent authority of the issuing country (or the diplomatic mission of that country in Vietnam) to obtain the Apostille stamp.

Sau khi đã được dán tem Apostille hợp lệ, giấy tờ đó sẽ được sử dụng trực tiếp tại Việt Nam mà không cần phải mang qua Đại sứ quán Việt Nam để Hợp pháp hóa lãnh sự nữa (theo tinh thần của Nghị định 293/2026/NĐ-CP).

Once the document bears a valid Apostille stamp, it can be used directly in Vietnam without requiring further consular legalization at the Vietnamese Embassy (per Decree 293/2026/ND-CP).

Thực hiện dịch thuật sang tiếng Việt và công chứng/chứng thực bản dịch là có thể nộp cho Nhà trường và các cơ quan chức năng.

Have the document translated into Vietnamese and the translation notarized or certified; it is then ready for submission to the University and relevant authorities.

Các trường hợp vẫn phải hợp pháp hóa lãnh sự truyền thống

Cases Still Requiring Traditional Consular Legalization

Thủ tục Apostille không áp dụng trong các trường hợp sau: Apostille does not apply in the following cases (traditional consular legalization is still required):

Giấy tờ do viên chức ngoại giao, viên chức lãnh sự lập.
Documents executed by diplomatic or consular officers.
Giấy tờ hành chính liên quan trực tiếp đến hoạt động thương mại hoặc hải quan.
Administrative documents directly related to commercial or customs operations.
Giấy tờ do các quốc gia, vùng lãnh thổ chưa có quan hệ áp dụng Công ước với Việt Nam cấp, bao gồm:
- Cộng hòa Liên bang Đức, Cộng hòa Áo, Cộng hòa Séc (đã là thành viên Công ước nói chung nhưng chưa thiết lập quan hệ áp dụng với Việt Nam)
- Vương quốc Thái Lan đến hết 28/02/2027
- Greenland (thuộc Đan Mạch), Tokelau (thuộc New Zealand) và các quốc gia không phải thành viên Công ước Apostille
Documents issued by countries/territories without Convention relations with Vietnam, including Germany, Austria, the Czech Republic (Convention members generally, but relations with Vietnam not yet established); Thailand until February 28, 2027; Greenland; Tokelau; and non-contracting states of the Apostille Convention.
